Terms of Service & User Agreement

Clear rules to keep THE DRIVERS community respectful, safe and meaningful for everyone.
  1. Platform: Smartphone application (iOS & Android), website, infrastructure, and all related sub-applications required for operation
  2. Application: Synonym for platform
  3. Visitor: You as a non-registered or logged-out user
  4. User: You as a registered account holder
  5. Products: Services, licences, and digital offerings
  6. TheDrivers: Brand and platform name
  7. Content: Comments, posts, videos, images, messages, routes, events, profiles, and groups
  8. Third-Party Services: Products and events provided by external providers

Overview & Scope

This platform is operated by get’osm AG, Kirchstrasse 5, CH-8962 Bergdietikon, Switzerland. Throughout this platform, the terms “we”, “us”, “our”, and “TheDrivers.App” refer to get’osm AG.

By accessing or using any part of the platform, you agree to be bound by these Terms of Service, including all policies referenced herein:

Privacy Policy | Content Policy

If you do not agree to all terms, you must not use the platform.

Licence

You are granted a non-transferable licence to use the platform on supported devices (including Apple and Android devices).

This agreement exists solely between you and get’osm AG. Apple Inc. and Google LLC (Alphabet Inc.) are third-party beneficiaries and may enforce this agreement where applicable.

Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of those updates.

General Conditions

  • We may refuse service at any time
  • You must be of legal age in your country
  • No illegal use of the platform is permitted
  • No copying, resale, or exploitation without written permission

Maintenance & Availability

We may restrict access for maintenance. There is no guaranteed uptime or availability.

Accuracy of Information

We do not guarantee that all information on the platform is accurate, complete, or current.

User Content & Intellectual Property

You are responsible for all content you share. You must own the rights to your content and ensure it does not violate any laws.

By uploading content, you grant us a worldwide, royalty-free, transferable licence to use, display, and distribute your content.

You retain ownership of your content. You may delete content at any time.

Third-Party Services & Events

We are not responsible for third-party products, services, or events.

Participation in events is at your own risk. You waive all claims related to injuries, damages, or losses arising from such participation.

Routes Feature Disclaimer

Routes are not intended for real-world navigation. Users must follow traffic laws and remain attentive at all times.

User Submissions

Any feedback, suggestions, or submissions may be used by us without restriction or compensation.

Personal Data

Errors & Corrections

We reserve the right to correct errors or inaccuracies at any time without notice.

Paid Services

  • Subscriptions (recurring payments)
  • One-time purchases

We may modify or discontinue paid services at any time.

Payments

Payments are processed via third parties:

  • Apple App Store
  • Google Play Store
  • Stripe

All payments are non-refundable unless legally required.

Subscriptions

Subscriptions renew automatically unless cancelled at least 24 hours before renewal.

Termination

We may suspend or terminate your account at any time for violations of these Terms.

Deleting your account does not cancel active subscriptions.

Prohibited Uses

  • Illegal activity
  • Harassment or abuse
  • Spreading malware
  • Collecting user data unlawfully
  • Security exploitation

Email & Communication

You may receive essential service emails. Marketing emails can be unsubscribed at any time.

Disclaimer of Liability

All services are provided “as is” and “as available” without warranties of any kind.

We are not liable for any damages, including loss of data, revenue, or business.

Warranty Disclaimer

Use of the platform is at your own risk. No guarantees are provided regarding reliability or accuracy.

Severability

If any provision is found invalid, the remaining provisions remain in effect.

Entire Agreement

These Terms constitute the full agreement between you and the company.

Governing Law

These Terms are governed by Swiss law. Jurisdiction is the registered office of the company.
